Use of The Lux Ride website at www.theluxride.com (collectively, the “Website”) and the online reservation services (the “Services”) provided by The Lux Ride are subject to the terms and conditions of use set forth below (“Terms of Use”), which include the Privacy Policy set forth in our online privacy policy and incorporated into these Terms of Use by reference.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE WEBSITE OR THE SERVICES. BY USING THE WEBSITE OR THE SERVICES, YOU AGREE TO THESE TERMS OF USE.

If an individual is using the Website on behalf of a business entity, whether as an employee, consultant, or agent of such entity, by doing so, such individual represents that they have the legal capacity and authority to bind such entity to the Terms of Use. “You” shall refer both to the individual accessing the Website on behalf of a business entity, if any, and any such entity itself.

If you do not agree to these Terms of Use, do not use the Website or the Services. The Lux Ride may change these Terms of Use from time to time without notice, and such changes will be effective on the date they are posted on the Website. Use of the Website after such changes constitutes your acceptance of all such changes.

2. Use of the Website and the Services

You may only use the Website and the Services in accordance with the Terms of Use, any posted policies and procedures that appear on the Website, and for lawful purposes. You agree not to use the Website to:
  1. transmit any material that infringes or misappropriates third-party rights, including copyright, trademark, trade secret, or patent,
  2. transmit false, misleading, or fraudulent material,
  3. distribute viruses, worms, or malicious code,
  4. use bots or automated systems that generate excessive traffic,
  5. transmit unlawful, obscene, vulgar, harassing, defamatory, or otherwise objectionable content,
  6. send unsolicited advertising or spam,
  7. attempt unauthorized access to the Website, servers, or networks,
  8. frame or deep-link the Website without prior written consent, or
  9. resell use of or access to the Website or Services without The Lux Ride’s prior written consent.

The Lux Ride reserves the right to terminate your access to the Website or Services at any time without notice if, in its sole discretion, you have abused or violated any of these terms.

3. ID Number, Password, and Security

You are responsible for maintaining the confidentiality of your user ID and/or password. You are solely responsible for all activities conducted under your account. You agree to notify The Lux Ride immediately of any unauthorized use of your credentials. The Lux Ride will not be liable for any loss or damage resulting from your failure to protect your account.

4. Services

Your use of the Services may be subject to additional terms communicated to you in writing or posted on the Website, including via email. Services are subject to availability, and all price quotes are estimates.

5. Proprietary Rights

The Website, Services, content, and underlying software are protected by intellectual property laws and owned by The Lux Ride and its licensors. You may not copy, distribute, or modify content without prior permission, except that you may download or print information for personal use related to reservations or use of the Services.

6. Warranty Disclaimer

THE WEBSITE, SERVICES, AND ANY INFORMATION PROVIDED ARE OFFERED “AS IS.” THE LUX RIDE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE, NOR THAT THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

(Some jurisdictions may not allow certain disclaimers, so these exclusions may not apply to you.)

Cruise Ship & Pier Pickups

  • Clients must contact dispatch at +1 (929) 999-6000 or the assigned chauffeur upon disembarking.
  • A 30-minute waiting window is provided. After that, full fare will be charged if no contact is made.
  • Grace periods: 15 minutes for cruise terminals, 10 minutes for piers. Waiting time charges apply after grace.
  • Any changes to scheduled pickup times must be requested at least 12 hours in advance.

7. Limitation of Liability

IN NO EVENT SHALL THE LUX RIDE, ITS PARTNERS, AFFILIATES, OR CONTRACTORS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, DATA, OR BUSINESS INTERRUPTION), ARISING OUT OF USE OR INABILITY TO USE THE WEBSITE OR SERVICES.

The Lux Ride’s total liability for direct damages shall not exceed the greater of:

  1. the amount paid by you for the specific service at issue, or
  2. $25.

(Some jurisdictions may not allow limitation of damages, so this may not apply to you.)

8. Indemnification

You agree to indemnify and hold harmless The Lux Ride, its affiliates, partners, contractors, and employees from any claims, damages, or expenses (including attorneys’ fees) arising from your use of the Website or Services, or your violation of these Terms.

9. Communications with The Lux Ride

Any communication you send to The Lux Ride (except as covered by our Privacy Policy) will be treated as non-confidential and may be used for any purpose, including development and marketing of services.

10. Privacy

The Lux Ride values your privacy. Please review our Privacy Policy for details on how we collect and use your information.

11. Severability

If any provision of these Terms is found unenforceable, the remainder will continue in effect.

12. Waiver

Failure by The Lux Ride to enforce any right shall not constitute a waiver of future rights or remedies.

13. International Access

The Website and Services are operated from the United States. Access from outside the U.S. is at your own risk, and you are responsible for compliance with local laws.

14. Arbitration

Any disputes will be resolved through binding arbitration in New York County, New York, under the rules of the American Arbitration Association (AAA). Costs shall be shared equally, except that the prevailing party may be awarded attorneys’ fees. This does not prevent The Lux Ride from seeking court relief for intellectual property or prohibited use issues.

15. Governing Law

These Terms are governed by the laws of New York State. You agree to exclusive jurisdiction and venue in New York County, subject to arbitration provisions above.

16. Force Majeure

The Lux Ride shall not be held liable for delays or failures due to circumstances beyond its reasonable control, including natural disasters, strikes, war, terrorism, embargoes, or government actions.

17. Entire Agreement

These Terms, together with policies posted on the Website, constitute the entire agreement between you and The Lux Ride, superseding all prior agreements.
